Terms of Service

The agreement between you and HYLVYN when you use our games, our apps and this website.

1. Who We Are and What These Terms Cover

These Terms of Service ("Terms") form an agreement between you and HYLVYN ("we," "us," or "our"), a game studio based in Belgium, and govern your use of our mobile games and applications ("Apps") and of this website. Our Apps include Apolune, Prismling and Pulsekor, and any future titles we release.

By downloading, installing, or using an App, you accept these Terms. If you do not accept them, please do not use the Apps.

These Terms do not replace the terms of the store you download from. Your download is also subject to the rules of Google Play or the Apple App Store, and where those store rules give you stronger rights, those rights continue to apply.

2. Your Licence to Use the Apps

We grant you a personal, non-exclusive, non-transferable and revocable licence to install and use the Apps on devices you own or control, for your own private, non-commercial entertainment.

We license the Apps to you; we do not sell them. All rights we do not expressly grant remain with us.

3. Age

Our Apps are intended for a general audience and are rated for players aged 13 and over. If you are under the age of majority where you live, you may only use the Apps with the involvement of a parent or guardian, who accepts these Terms on your behalf. Parents and guardians can manage purchases and device permissions through Google Family Link, Apple Screen Time, or the equivalent parental controls on the device.

4. What You May Not Do

When using the Apps, you agree not to:

  • modify, translate, or create derivative works of an App, except where mandatory law expressly allows it;
  • reverse engineer, decompile, or disassemble an App, except to the extent that applicable law expressly permits this despite this restriction (including decompilation for interoperability under EU law);
  • circumvent, disable, or interfere with security, anti-cheat, advertising, or purchase mechanisms;
  • use automated tools, modified clients, or exploits to manipulate scores, progression, rewards, or advertising;
  • redistribute, sell, rent, sublicense, or commercially exploit an App or its content;
  • remove or obscure any copyright, trademark, or other proprietary notices.

5. Purchases, Billing and Refunds

Some Apps offer optional in-app purchases, such as removing advertisements or unlocking cosmetic or convenience items. Purchases are entirely optional; the Apps remain playable without them.

All payments are processed by Google Play Billing or Apple In-App Purchases, never by us. Google or Apple handle the payment, the receipt, applicable taxes and the refund process. We never receive, process, or store your card or financial details.

Refunds are therefore requested through the store you purchased from, under that store's refund policy. Your statutory rights as a consumer, described in section 9, apply in addition to and are not limited by that policy.

Purchased items are licences to use digital content within the App. They have no monetary value outside the App, cannot be exchanged for cash, and cannot be transferred between accounts, devices, or Apps.

Right of withdrawal (EU/EEA): as a consumer you normally have 14 days to withdraw from a purchase of digital content. Where you ask for the content to be made available immediately and acknowledge that you thereby lose that right, the withdrawal right ends once delivery has begun — this is how in-app purchases are delivered.

6. Advertising

Some Apps display advertising served through Google AdMob, which keeps them free to play. In the European Economic Area, the United Kingdom and Switzerland we ask for your advertising consent before any ad loads, and you can change that choice at any time from the App's privacy options. Where an App offers a purchase to remove advertising, that purchase applies to the App you bought it in.

7. Your Privacy

Our handling of data is described in our Privacy Policy, which forms part of these Terms. In short: we do not require accounts, game progress is stored locally on your device, and the technical data our Apps process is collected by Google's advertising and store services rather than by servers of our own.

8. Availability, Updates and Game Changes

We work to keep the Apps available and stable, but we do not promise uninterrupted or error-free operation. Store availability, device compatibility, and operating-system support can change.

We may update the Apps to fix problems, improve balance, add or adjust content, or meet platform and legal requirements. We may also discontinue an App or a feature. Where a change materially reduces something you have paid for, we will act in line with your statutory rights under section 9.

9. Your Statutory Rights and Our Responsibility

Nothing in these Terms limits your mandatory rights as a consumer.

Digital content supplied to you must be as described and fit for purpose. Under EU and Belgian consumer law, including the rules implementing the Digital Content Directive, you are entitled to have non-conforming digital content brought into conformity, and to a price reduction or termination where that is not possible. These rights cannot be excluded by contract.

We are fully responsible for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intent and gross negligence, and for any other liability that cannot lawfully be limited.

For everything else, and to the extent the law allows, we are not liable for indirect or consequential loss, lost data that you could reasonably have avoided, or loss of in-game progress or virtual items resulting from your own device, from uninstalling an App, or from actions of the store or your device manufacturer.

Because game progress is stored locally on your device, uninstalling an App or resetting the device permanently deletes that progress.

10. Intellectual Property

The Apps, this website, and everything in them — including the HYLVYN name and phoenix mark, game titles, artwork, characters, audio, text, code, and design — are owned by HYLVYN or used by us with permission, and are protected by copyright and trademark law.

You may share screenshots, video, and streams of our games, including monetised content on platforms such as YouTube and Twitch, provided you do not claim the game as your own, do not distribute the game files, and do not present your content as officially endorsed by us. We may withdraw this permission for a specific use where it is misleading or harmful.

11. Suspension and Termination

You may stop using an App at any time by uninstalling it.

We may suspend or end your licence if you seriously or repeatedly breach these Terms, in particular the restrictions in section 4. Where the law requires it, we will give you notice and an opportunity to respond. Ending the licence does not affect purchases already delivered, and does not remove your statutory rights.

12. Changes to These Terms

We may update these Terms to reflect changes in our Apps, our platforms, or the law. The "Last Updated" date above will change when we do. For significant changes affecting your rights or your purchases, we will provide notice in the App or on this website. Continuing to use the Apps after a change takes effect means you accept the updated Terms.

13. Governing Law and Disputes

These Terms are governed by Belgian law. If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of the mandatory rules of the country where you habitually reside, and you may bring proceedings in the courts of that country.

If you have a complaint, please contact us first at info@hylvyn.com — we aim to resolve issues directly and will respond within 30 days.

Consumers in the EU may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr, or, in Belgium, the Consumer Mediation Service (Service de Médiation pour le Consommateur / Consumentenombudsdienst) at consumerombudsman.be.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision is replaced by a valid one that comes closest to its intended effect.
